Now a Spanish lawyer is advising these purchasers about their rights after these developers have gone into “compulsory administration”.The fear is that many of these people could lose their homes.These people have been given until the 2nd of december to register their claim.
It now seems that the company building this development started to sell properties off plan before they had the necessary permits to do so.It has also been alleged that the bank guarantees which were issued were issued by non-authorised insurance companies.
Cosequently anyone who has purchased off plan or who has a home which has not yet been completed ,should make sure that they have registered as one of the creditors.They will need to supply all of the documentation that they have to show monies paid,contracts made and the like.One of the most important documents is the bank guarantee which could make the difference between having money refunded and losing everything.
In a perfect world each person involved should have a lawyer who specialises in insolvency law and who will advise on all of the paperwork necessary for the courts.
