A land-mark legal case in the European Court of Justice has said that the Spanish government must pay back 300 million euros to non-Spanish residents who were overcharged on their capital gains tax from 1997 to 2006.This ruling paves the way for the repayment of the tax .The 300 million would be paid to UK residents alone.
Anyone who sold a property in Spain between these dates can now make a claim if they think that they have been illegally overcharged on this property tax.The ECJ is saying that the Spanish government unfairly overcharged these people.The average tax reclaim will be 15,000 euros and it has been estimated that 90,000 UK citizens are involved.Other EU citizens could also now come forward to reclaim too.
These people were ordered to pay a 35% CGT while Spanish citizens paid a great deal less at 15%.
