Spanish News-Wills In Moraira

Expats living in Spain were given some good advice in Moraira last week about the writing of their wills.The talk was organised by Caja Murcia and speakers gave advice to expats about the legalities of their will here in Spain and in the Valencian region in particular.

The meeting was split into two sessions,the first involving the giving out of information by speakers and the second was a question and answer session.The legal representitive explainrd that there are three types of will:-the holographic,the open and the closed.He was suggesting that the open will was the best.

You need to be over the age of 14 years to actually write a will and should present an identification card and an NIE number to the notary.Expats can have two wills–one covering their assets here in Spain and the other assets in their country of origin.There must be a clause which ensures that neither cancels the other out.

To claim an inheritance the inheritor has to acquire various documents.Firstly the death certificate has to be acquired up to 15 days after the death,a certificate of the registration of the last will,a certificate of any insurance policies and a copy of the will.The title deeds of the estate,land registration certificate,bank balance,life insurance policies,vehicle documentation and any debts,including the funeral expenses.

The last part was a question and answer session and many people in the audience took the opportunity to ask questions relating to inheritance taxes and other related taxes.Inheritance tax is generally lower for those who are resident and signed on to the padron.More information can be found on www.notariado.org or www.gva.es
